RICHMOND, Va. (WRIC) — A state court of appeals will decide whether a Henrico County judge was correct to dismiss perjury and forgery charges against former Delegate Joe Morrissey.
When Morrissey struck a plea deal for charges of contributing to the delinquency of a minor he received immunity from additional charges from that case.
Afterwards, when prosecutors accused Morrissey of perjury and forgery, the judge dismissed the charges — citing the potential for double jeopardy.
He also suggested the appeal.
Morrissey’s camp says it expected an appeal and expects to prevail.
