RICHMOND, Va. (WRIC) — The Commonwealth’s case against the maker of a controversial guardrail is moving forward.
Thousands of E-T Plus guardrails, made by Trinity Industries, were installed and still line Virginia highways. These guardrails have been linked to dozens of deaths and injuries across the country.
Now, a judge has rejected Trinity’s motion to dismiss the case.
Trinity was recently found guilty of defrauding the government for not disclosing changes made to the design of its guardrail after it was approved. The company has maintained that the E-T Plus system is safe and passed crash tests.
Trinity now has about three weeks to file a response. We’ll keep you posted on what happens.
