MUNCIE, Ind. (WISH) — Indiana State Police say a Muncie man was speeding and driving while intoxicated with his son under 10 years old in the passenger seat.
A trooper clocked 32-year-old David Kennedy with driving 89 mph in a 55 mph zone on the Muncie bypass (U.S. 35) near Memorial Drive Friday around 4:45 p.m.
ISP says Kennedy had a blood alcohol content level over the .08% legal limit. He reportedly had a child under 10 years of age in the passenger seat.
Kennedy was arrested and preliminarily charged with operating as a habitual traffic violator, a level six felony; operating while intoxicated with a prior conviction within five years, a level six felony; and operating while intoxicated endangering a passenger under 18 years of age, a level six felony. He also faces charges for speeding and operating a vehicle with a false registration.
Kennedy was booked into the Delaware County Jail and his son was released to family members.
