WATERVLIET, NY (NEWS10) – 49-year-old Michael Fox was arrested for fatally killing 29-year-old Brandon Sherwin with a shotgun.

On Friday evening at around 9 p.m. patrol units responded to the area of the 2300 block of 4th Avenue in the city of Watervliet for a report of shots fired.

Upon arrival, units made contact with a female witness who indicated that the incident had occurred in a two-family residence at 2320 4th Avenue.

A two-man patrol unit that responded to the residence indicated that they saw damage consistent with shotgun projectile in the door of the common hallway.

Officers tactically took cover and began to establish a perimeter around the building and ensure the safety of those in the vicinity.

Mutual aid was requested from Emergency Response Teams from the New York State Police, Colonie Police, Troy Police, Albany County Sheriff’s Department, and Rensselaer County Sheriff’s Department.

After failed attempts to negotiate, a tactical team made entry into the residence and placed Fox into custody.

Sherwin, the apparent victim of homicide, was found dead in the residence.

It was confirmed that Brandon Sherwin is the son of former NFL player Tim Sherwin, who played for the Colts for seven years and also had a brief stint with the New York Giants back in the late 1980s.

Fox is currently in custody and has been arraigned on a number of charges including Menacing, Criminal Possession of a weapon and murder. He was remanded to Albany County Jail without bail.

Investigation is still ongoing.
